Dialysis Patient Allowed to Sit for Hours in Own Waste

Emma Lee Randolph was supposed to be going to the Kidney Center of Beaumont, Texas for dialysis to improve her health. Instead, according to a lawsuit filed by her family, she was neglected, which caused her health to deteriorate and led to her death.

Torrence Randolph and three of his siblings filed suit against the Kidney Center and two of its physicians, Dr. Shariq Ahmad and Dr. Mark Wilson, in the Jefferson County District Court on Feb. 27, reported the Southeast Texas Record.

Randolph was a resident of the Silsbee Oaks Nursing Home. While there, she was required to go to The Kidney Center for dialysis several times a week. "These were long visits-frequently lasting between six to eight hours," the suit said.

The suit alleges the Kidney Center staff allowed her to sit in a wheelchair without being repositioned, receiving incontinent care, receiving adequate nutrition and receiving adequate hydration.

The plaintiffs claim Randolph was left to sit in the same position for hours in her waste. Her nutrition was not monitored by staff and she did not receive assistance with eating meals and drinking necessary fluids, the family contends.

The family’s suit went on to say, "Despite being repeatedly warned by the nursing home staff that such neglect would be catastrophic to Ms. Randolph, the physicians and staff at the Kidney Center did nothing to improve and as a result, Ms. Randolph became dehydrated, malnourished and developed severe bedsores, which later became infected.”

The Randolph children are suing for exemplary damages, plus their mother's past and future suffering. The plaintiffs seek a trial by jury and are represented by the Packard, Packard & Lapray law firm. The case is assigned to Judge Milton Shuffield, 136th Judicial District.
